Please read these Terms of Service ("Terms") carefully before using Kenji ("Kenji", "Kenji Meals", the "Service"). The Service is operated from Greece by DigitalBox Studios ("we", "us", "our"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Definitions
"Application" means the Kenji mobile app and any related software and updates. "Service" means the Application, our website, and all associated AI tools, content, and features. "User Content" means photos, text, preferences, and other content you submit through the Service. "You" means the person using the Service.
2. Eligibility and Age
You must be at least 15 years old to use the Service, which is the minimum age for consent to online services under Greek law implementing the GDPR. If you are between 15 and 17, you may use the Service only with the involvement of a parent or guardian who accepts these Terms on your behalf. The Service is not intended for, and must not be used by, anyone under 15.
3. Health, Nutrition and Allergen Disclaimer
Kenji is a meal-planning and nutrition tool. It does not provide medical advice, diagnosis, treatment, or professional nutritional counselling, and it is not a substitute for advice from a qualified healthcare professional.
All calorie counts, macros, nutrition values, prices, prep times, recipes, and food identifications are automated estimates and may be incomplete or inaccurate. Do not rely on them for medical, clinical, or safety-critical decisions.
Allergens and dietary tags: diet labels and filters (for example "gluten-free", "shellfish-free", "vegan", or allergy exclusions) are generated automatically on a best-effort basis and are not a guarantee that a dish is safe for you. If you have a food allergy, intolerance, or medical dietary requirement, you must independently check every ingredient and product label before buying, preparing, or eating any meal. We are not liable for reactions, harm, or loss resulting from reliance on automated tags, estimates, or AI suggestions.
If you have an underlying health condition, are pregnant, or are starting a significantly different diet, consult a healthcare professional first.
4. AI Features and Third-Party Processing
Kenji uses artificial intelligence to suggest recipes, estimate nutrition, tune portions, and interpret meals. We do not build or train our own AI models on your data. AI requests are processed by a third-party AI provider (currently DeepSeek) acting as our service provider, and are subject to their processing on our behalf. Where you photograph a meal or your fridge, the image is analysed on your device and only the resulting text description is sent for AI processing — we do not send your photos to the AI provider.
5. Your Content and Licence
You keep ownership of your User Content. You grant us a limited, worldwide, royalty-free licence to host, store, reproduce, transmit, and process your User Content solely to operate and provide the Service to you (for example, to generate plans, sync your saved recipes, and run AI features). This licence does not permit us to sell your content or to use your meal photos to train AI models.
You represent that you own or have the rights to the content you submit, and that any photo you upload which contains other identifiable people has been shared with their consent. You agree not to submit unlawful, infringing, harmful, or offensive content.
6. Acceptable Use
You agree not to:
- reverse engineer, decompile, scrape, or copy the Service or its content;
- access the Service's APIs or AI features through automated means, resell access, or circumvent usage limits, rate limits, or subscription gating;
- interfere with, overload, or attempt to gain unauthorized access to the Service or its infrastructure;
- upload content that is unlawful, violent, explicit, or infringes others' rights;
- use the Service to provide medical or nutritional advice to third parties.
7. Subscriptions, Billing and Cancellation
Kenji offers optional auto-renewing subscriptions. Purchases are made and processed through the Apple App Store (managed via our provider RevenueCat); Apple's terms govern payment, renewals, and refunds. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You manage or cancel your subscription in your App Store account settings. As an EU consumer you may have a statutory right of withdrawal; note that by starting to use digital content immediately you may acknowledge the loss of that withdrawal right to the extent permitted by law.
8. Third-Party Services
The Service relies on and links to third parties (including Apple, DeepSeek, RevenueCat, and analytics providers). We do not control and are not responsible for third-party services, and your use of them may be governed by their own terms.
9. Intellectual Property
All rights in the Service (excluding your User Content) belong to us or our licensors. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our written permission.
10. Termination
We may suspend or terminate your access if you breach these Terms or misuse the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including disclaimers, liability limits, and intellectual property) continue to apply.
11. "As Is" Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. Nothing in these Terms excludes or limits any rights you have as a consumer that cannot be excluded under applicable mandatory law.
12. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits or data, arising from your use of the Service. Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred euros (€100). Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.
13. Governing Law and Disputes
These Terms are governed by the laws of Greece, without affecting any mandatory consumer-protection rights you have in your country of residence. Disputes are subject to the competent courts of Greece, except where mandatory law entitles you to bring proceedings elsewhere. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and provide reasonable notice. Continued use of the Service after changes take effect means you accept the updated Terms.
